Discord bots
Terms of Service
The short version
- Use our bots the way they’re meant to be used, and follow Discord’s own rules.
- Don’t use them to hurt people, spam, or attack the service.
- The bots are provided as they are. We work hard to keep them running, but we can’t promise they always will.
- Some bots connect to paid Arkship products. Anything you buy there may come with its own terms.
- Texas law governs these terms.
01Who we are and what this covers
These Terms of Service (“Terms”) are an agreement between you and Arkship (“Arkship,” “we,” “us”). They cover every Discord bot and Discord application that Arkship runs (each a “Bot”), including the Tinyhost bot.
By adding a Bot to a server, or by using a Bot’s commands, buttons, or forms, you agree to these Terms. If you don’t agree, please don’t use the Bots. Our Privacy Policy explains how we handle information and is part of these Terms.
02Discord’s rules still apply
The Bots run on Discord, so your use of them is also subject to Discord’s Terms of Service and Community Guidelines. Nothing here replaces those. Anything Discord’s rules forbid, these Terms forbid too.
03Who can use the Bots
You must meet Discord’s minimum age where you live (13 in most countries) to use a Bot. If you add a Bot to a server, you confirm that you have permission from that server’s owner or admins to do so.
04Using the Bots
You agree not to:
- use a Bot to harass, threaten, or harm anyone, or to break any law;
- spam a Bot, flood it with requests, or try to overload, disrupt, or break it;
- get around a Bot’s limits, permissions, or security, or try to reach data that isn’t yours;
- copy, reverse engineer, or resell a Bot or its features, unless the law allows it or we’ve said you may;
- pretend to be Arkship or anyone else while using a Bot;
- use a Bot to share or store anything you don’t have the right to share.
05If you run a server
If you manage a server where a Bot is installed, you decide who in that server can use it through Discord’s permission settings, and you’re responsible for making sure that use fits these Terms. You can remove a Bot from your server at any time.
06Paid products and connected services
Some Bots are the Discord side of other Arkship products, such as Tinyhost, and some of those products cost money. Prices, and any extra terms that come with a purchase, are shown to you before you pay, and they apply alongside these Terms. If a product takes payment, a third-party payment processor handles your card details; we never receive your full card number.
07Your content
You keep ownership of anything you give a Bot, such as names, settings, or text you type into a command or form. You give us permission to store, process, and display it only as needed to run the Bots and the products they connect to.
08Changes, availability, and ending
We may change, pause, or stop any Bot or feature at any time. We’ll try to give notice before big changes, but we can’t always. We don’t promise that any Bot will always be available or free of errors.
You can stop at any time by removing a Bot from your server or no longer using it. We may suspend or block your access, or remove a Bot from a server, if you break these Terms or Discord’s rules, or if we need to protect the Bots, other users, or ourselves.
09No warranty
The Bots are provided “as is” and “as available.” To the fullest extent the law allows, Arkship disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10Limits on our liability
To the fullest extent the law allows, Arkship is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, that comes from your use of, or inability to use, the Bots. Our total liability for any claim about the Bots is limited to the greater of (a) what you paid us for the product the claim is about in the 12 months before the claim, or (b) US $50.
Some places don’t allow these limits, so some of them may not apply to you.
11Responsibility for misuse
If someone brings a claim against Arkship because you used a Bot in a way that breaks these Terms or the law, you agree to cover the reasonable costs that result, to the extent the law allows.
12Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute about these Terms or the Bots will be decided in the state or federal courts located in Texas, and you and Arkship both agree to those courts’ jurisdiction. If the consumer protection laws where you live give you rights that these Terms can’t take away, you keep those rights.
13Changes to these Terms
We may update these Terms. When we do, we’ll change the date at the top of this page. If a change is significant, we’ll also make a reasonable effort to let you know, for example in the Bot’s Discord server or on this page. If you keep using a Bot after a change takes effect, you accept the updated Terms.
14Everything else
If any part of these Terms can’t be enforced, the rest still applies. If we don’t enforce a part of these Terms right away, we haven’t given up the right to enforce it later. These Terms, together with the Privacy Policy and any product terms shown to you at purchase, are the whole agreement between you and Arkship about the Bots.
